☆ Terms of Service ☆
NOTICE: Any of the statements below can be negotiated at time of payment.
If your commission is accepted, a private message will be sent with proof of the transaction, and a digital receipt. At this time, please verify that all information is correct. Any changes MUST be made at this point.ALSO: I hold the right to amend this TOS at any time. Upon update, you’ll be made aware if any changes impact you as the client.
I. GENERAL TERMS.
Within this document, terms “I” and “me” will refer to the artist, Rattacadabra (or Grey) and “You” will refer to the client/commissioner and all terms affiliated with.Please be civil in all aspects of the commission. I will be more likely to accept a commission written out with clear and direct language. Provide neat references, and/or a simple description. If your reference(s) are shaded, it would be appreciated if you would give a color reference swatch for easier matching.Please don't be a jerk. I'll work with you, but only if you're nice about it. Uncivil behavior can/will result in termination of service.
Follow the rules provided in this document.If you fail to follow the rules provided I have the right to decline your commission. I will not do so lightly, but I put these rules in place for a reason.
II. PAYMENT
I will accept a partial payment for commissions valued over $50. All commissions otherwise must all be paid in full upfront.I accept PayPal or Kofi. An invoice will be created and sent if payment received is via paypal. You understand that you are purchasing a digital good, and cannot request a refund upon receiving the product. All sales are final.If the product cannot be completed, a refund will be issued. For more info see the Canceling/Refund policy below.
III. PROCESS
Works In Progress (WIPs) are a part of my process and will be provided unless the client requests otherwise. WIPs will be given if I have a question about how a commission is going.If you specifically do NOT want a WIP, please let me know beforehand and I will make sure to keep it a surprise.The standard time for a commission is between 1-2 weeks. Time will vary, depending on the art/character complexity.Please keep in mind that I am human, and it might take more time to complete a commission if something comes up. I will attempt to notify commissioners via private message or other form of direct communication.If you have not received your commission within 5 weeks, and I have not notified you of any issues, please contact me respectfully either through private message or through any linked social media.
IV. CUSTOMER SATISFACTION
Satisfaction with the end result is my highest priority. However, after a commission is finished only small changes are allowed to be made, such as coloring/rendering mistakes.Any large changes such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely will come with an extra charge of $50 (USD) for the additional time spent.
V. COPYRIGHT / USAGE POLICY
(this is legal and stuff. Not as fun to read, but still important to make sure you have an understanding.)I, the artist, hold every right to the produced drawing, not the commissioner.
Therefore I’m allowed to use the copyrighted artwork to:- Promote myself within any place or site.- To display it anywhere to my liking.The Commissioner/s are allowed to;- Use the copyrighted artwork for personal use only unless agreed otherwise.- Print the art and claim the right of their character(s) but not the drawing itself.- Use the art to promote themselves with proper credit given to the artist.- Include the downloadable content in the character's selling folder, with credit clearly given and watermark/signature intact.The Commissioner/s are not allowed to;Repost the art without my, the artist’s, consent. You are granted consent if you do at least two of the following:- Link or credit me as the artist.- Link my accounts or the original post uploaded to one of my accounts.- Create a post that includes 1. The original posted artwork and 2. My name, account, and preferably (not required) the prices of my, the artist’s commissions.I, as the artist, will never;- Claim the character, or any part of the image owned and/or copyrighted by the commissioner, as my own- Use the said characters/copyrighted work for personal use (ie. Storytelling, roleplaying)If you break this legally binding document in any way, you will be placed on a list which will affect my judgment in allowing further commissions from me, as well as give me the right to file a DMCA takedown.The following is considered Copyright Infringement:- Reproducing/using the copyrighted artwork commercially. (Meaning making money in any way. The only exception is my written consent.)- Taking Credit for the creation of the artwork.- Removing any watermarks/signatures.- altering the artwork without my, the artist’s, consent.(In short, the art is mine but the character(s) are not. Please be responsible and give credit where it is due, and we will not have a problem.)
VI. CANCELING/REFUNDING POLICY
I have the right to cancel AND refund the money for your commission in full at any time.I will not cancel or refund without reason. I will always give one BEFORE refunding, and if possible, a compromise may be reached in terms of the incomplete product and/or the refund itself.Your right to cancellation and full refund is valid up until the coloring stage, at which point only a partial refund may be issued. You, as the client have no right to cancel or demand a refund from the artist once the final product received is:a. The promised quality.
b. all requests and inquiries have been fulfilled.
You understand that you are purchasing a digital good, and cannot request a refund upon receiving the product. All sales are final.If money has not been sent yet, the commissioner has the right to cancel the commission.
If you MUST request a refund after work is started, you will be placed on my caution list and this will be taken into consideration before another commission is accepted.______________
